Bodica — Body Language Analysis App

1. Introduction

These Terms of Service ("Terms") govern your use of the Bodica mobile application ("App") developed by Anil Burcu ("we," "us," or "our"), an independent developer.

By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. Eligibility

You must be at least 13 years old to use Bodica. By using the App, you represent that you meet this age requirement. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account

You may create an account using your email address, Apple Sign-In, or Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. App Description and AI Disclaimer

Bodica is an educational app that teaches body language concepts through lessons and quizzes, and provides AI-powered body language analysis of photos you submit.

Important Disclaimer: The AI analysis feature is for educational and entertainment purposes only. It does not constitute and should not be relied upon as professional advice of any kind, including but not limited to psychological assessment, medical diagnosis, career counseling, relationship advice, or legal advice. The analysis is generated by artificial intelligence and may be inaccurate, incomplete, or misleading. You should not make important personal, professional, or health-related decisions based solely on the App's analysis results.

5. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Upload photos of individuals without their consent for analysis.
• Upload photos containing illegal, harmful, abusive, or explicit content.
• Attempt to reverse engineer, decompile, or tamper with the App.
• Use automated means (bots, scrapers) to access the App or its services.
• Circumvent rate limits, security features, or access controls.
• Resell, redistribute, or sublicense access to the App.
• Use the App in any way that could harm, disable, or impair the service.

We reserve the right to terminate access for violations of these rules.

6. Subscriptions and Payments

6.1 Premium Subscription

Bodica offers a Premium subscription with additional features. Subscriptions are available as monthly and yearly plans, purchased through the Apple App Store or Google Play Store.

6.2 Billing

All payments are processed by Apple or Google through their respective app stores. We do not collect or store your payment information. Prices are displayed in your local currency as determined by the app store and may include applicable taxes.

6.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel your subscription through your device's app store settings (Apple: Settings → Apple ID → Subscriptions; Google: Play Store → Subscriptions).

6.4 Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. We cannot process refunds directly. To request a refund, contact Apple Support or Google Play Support.

6.5 Free Trial

If a free trial is offered, it converts to a paid subscription at the end of the trial period unless cancelled. The specific trial duration and terms are displayed before purchase.

7. Intellectual Property

All content in the App — including but not limited to lessons, quiz content, illustrations, icons, design elements, and software code — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.

Your submitted photos remain your property. By submitting a photo for analysis, you grant us a limited, temporary license to process the photo solely for the purpose of providing the analysis. This license terminates immediately after the analysis is complete.

8. User Content

You retain ownership of any photos you submit for analysis. You represent that you have the necessary rights to submit any photo, and that the photo does not violate any third party's rights, including privacy rights.

We do not store your photos on our servers. Photos are forwarded to Google's Gemini API for analysis and are immediately discarded by our systems.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or secure.
• We do not warrant the accuracy, completeness, or reliability of any AI analysis results.
• In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or €50, whichever is greater.

These limitations do not affect any rights that cannot be excluded or limited under applicable law, including consumer protection laws in your jurisdiction.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the App, or your infringement of any third party's rights.

11. Third-Party Services

The App integrates with third-party services (including Google Gemini API, PostHog, Sentry, RevenueCat, and Expo). Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

12. Account Deletion

You may delete your account at any time through the App: Settings → Personal Details → Delete Account. Upon deletion, your personal data on our servers is permanently removed as described in our Privacy Policy. Active subscriptions must be cancelled through the App Store or Google Play before account deletion.

13. Modifications to the Terms

We reserve the right to update, modify, or replace these Terms at any time, at our sole discretion. Changes may include adding, removing, or revising any section of these Terms. We will notify you of changes by updating the "Last Updated" date at the top of this page. It is your responsibility to review this page periodically for any changes. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you disagree with the changes, you should stop using the App and delete your account.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey. Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Ankara, Turkey.

If you are a consumer in the European Union, you also retain any mandatory consumer protection rights provided by the laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
